CASE AGAINST THE PLAINTIFF TASEN AND THE DEFENDENT ELIAS SHABAN

CASE HISTORY

On the 22nd of October, 2017, the Plaintiff purchased a Tasen F3 Android 4.2.2 handset from a retailer and has in documentation a valid receipt for Kshs. 3,500. The receipt is evidence of legal ownership of the device and also included the terms and conditions for sale.

There is a service warranty for 14 days valid after purchases; a disclaimer for faulty accessories with direct connotation to hardware such as memory cards, flash disks and batteries and, indirect connotation to faulty chargers and earphones although not directly printed on the receipt causing a loophole in procurement of goods included in the retailed packaged goods and asset disposal of the same and also, there is no reference in the contract on the receipt to the software developer in case of software failure. This is a case of negligence and failure to adhere to the terms and conditions of the Patent License Owner by the Defendent which states in part that the responsibility of redistribution of the Work lies with the Defendent.

This constitutes a breach of civil rights against the Plaintiff who transferred currency to a retailer on goodwill that the receipt is evidence enough for personal security and the Defendant infringed those rights by refusing to honor the terms and conditions on the receipt contract initially, during warranty validity for both software and hardware.

DEDUCTION

The retailer acknowledges that there does in fact exist a liable damage on the device which does constitute the validity of a claim against the Defendant by the Plaintiff to sue for damages amounting to USD $85,000,000.00 after legal fees and income tax. Terms of Recompense

Under the general terms understood in this transaction is that, in case of a disagreement, refer to a modified copy and this is acceptable but, does not imply the exclusion of the currency penalty.

I will reserve the rights to commercialize the modified Work globally so we can all vote on smartphone networks.

In the interest of preserving commerciability of this venture, it must be understood in supply chain management, I will act as the Sole Distributor of the modified Work to the Independent Electoral and Boundaries Commission who in turn will sell at wholeseller price to the Kenyan Government who will, lastly flag of distribution at retail price to the Kenyan public at the same value of Ksh. 3,500 (USD $35) inclusive of Modification.

Should there be an interested Contributor in this venture, the Work will relaunch with Whatsapp, Opera Mini and an IEBC app only. For third-party apps, the consumer can purchase a device of another choice from other sources. This Whatsapp function will integrate the e-government services by default of the President of the Republic of Kenya's server and not personal contacts. The package must also include a license for a fifth mobile service provider whose network coverage is only centered around polling stations on GSM WAN and WiFi LAN. For the rest of the Country, the Plaintiff proposes that a new SIM contract be placed under scrutiny by the Public Procurement and Disposal Act (2015) for the Commission. In whole, it is the National Asset that we have to protect first.

In the interest of National Security of acquisition and disposal of assets, the USD $85,000,000.00 should be delivered to the Central Bank of Kenya in USą0.50 coin denomination. The Central Bank of Kenya will then carry out a foreign currency exchange at prevailing market price and deposit the Kenya Shillings in the choice of two M-Banking mobile money accounts associated with the device IMEI. It's a security protocal to protect privacy.

The individual coins from the US Treasury? I dedicate them to the Kenya Defence Forces to develop bullet heads for their arsenal and our National Security.

Since the Defendant is a minority or disadvantaged, everything must be done under the Law.
